In his opening remarks, Father Fidelis Mukonori emphasized 4 key issues that need to be addressed: 1) Free, prior and informed consent, 2) Fair and comprehensive compensation, 3) Inclusive socio-economic development and profit-sharing schemes, 4) Planning and budgeting for relocation and compensation of affected communities before the commencement of a project.
Guest speaker Prof. Mandi Rukuni unpacked 8 land rights that matter to any kind of tenure system and emphasized that the ambiguity in the laws in terms of the definition and interpretation of public land and state land allows that customary land rights are not adequately protected and respected if land is compulsorily acquired by the state for development. In the context of devolution, he called for provinces and districts to always have a budget in place to deal with issues of compulsory acquisition of land and compensation of the affected people.
